Welcome to KOUTCH. These Terms of Service ("Terms") govern your access to and use of the KOUTCH mobile application, website, and related services (collectively, the "Services") provided by KOUTCH s. r. o., a company registered in Slovakia with company registration number (IČO) 57228868, located at Prievozská 1316/10, 821 09 Bratislava - mestská časť Ružinov ("KOUTCH," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Description of Service

KOUTCH is a fitness platform that connects personal trainers with athletes. Our Services include:

• A platform for trainers to create and manage workout programs
• Tools for athletes to track workouts, progress, and personal records
• Communication features between trainers and athletes
• Payment processing for subscription services
• Analytics and reporting for fitness progress
• Community features and leaderboards

Account Registration

To use certain features of our Services, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover any security breaches related to your account
• Take responsibility for all activities that occur under your account

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

User Responsibilities

You are responsible for your use of the Services and for any content you provide. You agree not to misuse the Services or help anyone else do so.

Trainer-Specific Terms

If you use our Services as a trainer, you additionally agree to:

• Hold appropriate qualifications and certifications for providing fitness training
• Provide safe and appropriate training programs for your athletes
• Not provide medical advice unless you are qualified to do so
• Maintain appropriate insurance coverage for your training activities
• Comply with all applicable laws regarding fitness instruction in your jurisdiction
• Set fair and transparent pricing for your services

Athlete-Specific Terms

If you use our Services as an athlete, you additionally agree to:

• Consult with a healthcare provider before beginning any new exercise program
• Use the Services at your own risk and take responsibility for your physical health
• Inform your trainer of any medical conditions or limitations
• Follow training programs safely and within your physical capabilities

Subscriptions and Payments

Some features of our Services require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees and charges
• Provide valid payment information
• Authorize us to charge your payment method on a recurring basis

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Refunds are provided in accordance with our refund policy and applicable law.

Intellectual Property Rights

The Services and their original content, features, and functionality are owned by KOUTCH and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create and upload to the Services, but you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display your content in connection with operating and improving the Services.

Limitation of Liability

To the maximum extent permitted by applicable law, KOUTCH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

You may delete your account at any time through your account settings. Upon account deletion, we will delete your personal data in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
